Terms of Use

These Terms of Use (the “Terms”) apply to the websites of Greenqloud and its subsidiaries, including but not limited qstack.com (“Site”). These Terms govern your use of the Site and all the text, data, information, software, graphics, photographs, and more (collectively “Materials”). By accessing, browsing or using the Site, you acknowledge that you have read, understood and agree to be bound by these Terms and to comply with all applicable laws and regulations, including all applicable export and re-export control laws and regulations. If you do not agree to these Terms, you are not authorized to use these websites.

Greenqloud reserves the right to change, modify, add or remove portions of these Terms at any time at its sole and absolute discretion. It is your responsibility to check these Terms periodically for changes. If you object to any such changes, your sole recourse shall be to cease using the Site. Continued use of the Site following any such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes. Certain provisions of these Terms may be superseded by expressly designated legal notices or terms located on particular pages of the Site and, in such circumstances, the expressly designated legal notice or term shall be deemed to be incorporated into these Terms and to supersede the provision(s) of these Terms that are designated as being superseded.

Unless otherwise specified, the Site is for your own personal, non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Site.

 

1. Greenqloud Trademarks and Logos

Greenqloud reserves all rights to its trademarks, service marks and logos, collectively referred to as “GQ Marks”.

Unless a formal written agreement exists between you and Greenqloud expressly stating otherwise, GQ Marks may only be used in accordance with the style guides available at: Qstack Brand Guide. Any other use is strictly prohibited unless licensed within a formal written agreement between you and Greenqloud.

Greenqloud does not object to the use of the GQ Marks to refer specifically to the products of Greenqloud. Using the GQ Marks without special license is permitted in advertising, marketing collateral, reporting, or a website that references your connection with Greenqloud (e.g. the material states that you are a partner or customer of Greenqloud).

The use of the GQ Marks is conditioned upon the following:

  • It may not be imitated or used as a design feature in any manner.
  • It may not be used in a manner that would disparage Greenqloud or its products or services.
  • The GQ Marks may not be used in any other company name, product name, service name, domain name, website title, publication title, or the like.
  • Non-Greenqloud materials should not mimic any Greenqloud advertising, product packaging, or website design.

The GQ Marks are highly valued intellectual property, and therefore Greenqloud will take the necessary steps to guard against dilution and the use of third-party marks which are confusingly similar to GQ Marks or which are likely to cause confusion with GQ Marks.

The GQ Marks must be used as adjectives, rather than as nouns or verbs.

Qualified legal counsel should be consulted in order to distinguish a referential use from an infringing use.

Greenqloud reserves the right in its sole discretion to terminate or modify permission to display the GQ Marks, and may request that third parties modify or delete any use of the GQ Marks that, in Greenqloud’s sole judgment, does not comply with these guidelines or might otherwise impair Greenqloud’s rights in the GQ Marks. Greenqloud further reserves the right to object to unfair uses or misuses of its trademarks or other violations of applicable law.

2. Copyright

Except where otherwise specified, the contents of the Site are subject to copyright, trade dress and various other intellectual property rights. Copyright © 2010-2015 Greenqloud. All rights reserved.

The contents of the Site are protected by copyright and intellectual property laws in the EU, the United States and other countries as well as by international treaties. You may not copy or distribute any portion of the Site, except as necessary to view the Site.

3. Use of the Site

You are not authorized to use the Site in any of the following ways (these are examples, not a complete list) if it:

  • Attempts to gain unauthorized access to any portion of the Site, whether through hacking, password mining, or any other means;
  • Violates the security or integrity of the Site.

4. Linking to the Site

You may create links to the Site from other websites but only in accordance with all applicable laws and the following terms, unless an express agreement states otherwise:

  • You may refer and link to, but may not copy, any Materials;
  • You may only use and reproduce GQ Marks if you follow our trademark and logo usage policy found here: Qstack Brand Guide;
  • You shall not create a browser or border environment around any Materials;
  • You shall not imply that Greenqloud endorses or is affiliated with any such website that links to the Site or any products, services, or content available through that website;
  • You shall not misrepresent your relationship with Greenqloud;
  • You shall not present false or misleading information about Greenqloud, its products, or its services;
  • The website that links to the Site shall not contain content that could be construed as illegal, distasteful, offensive, or controversial;
  • The website that links to the Site shall contain only content that is appropriate for all age groups; and
  • The website agrees to promptly modify to delete all Greenqloud related content upon request by Greenqloud.

5. Links to Third Party Websites

Links on the Site to third-party websites are provided solely for your convenience. If you access those links, you will leave the Site. Greenqloud does not endorse or make any representations about such third party websites or their entities, products or services. Greenqloud is not responsible for the content or availability of those websites. Privacy and security policies may differ from those practiced by Greenqloud.

6. Submission of Ideas

Greenqloud or any of its employees do not accept or consider unsolicited ideas, including ideas for new advertising campaigns, new promotions, new products or technologies, processes, materials, marketing plans, or new product names. Please do not send any original creative artwork, samples, demos, or other works. The sole purpose of this policy is to avoid potential misunderstandings or disputes when Greenqloud products or marketing strategies might seem similar to ideas submitted to Greenqloud. Please do not send your unsolicited ideas to Greenqloud or anyone at Greenqloud. If despite our request that you not send us your ideas and/or materials, you still send them, please understand Greenqloud will not treat them as confidential or proprietary.

7. Indemnification

You agree to indemnify and hold Greenqloud, its affiliates, subsidiaries, officers, agents, partners, employees, and licensors harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your content or your usage of the Site, your breach of these Terms or Greenqloud’s copyright or privacy statements, or your violation or infringement of any third party rights.

8. Disclaimers

Information on the Site is not promised or guaranteed to be correct, current or complete, and the Site may contain technical inaccuracies or typographical errors. Greenqloud assumes no responsibility (and expressly disclaims responsibility) for updating the Site to keep information current or to ensure the accuracy or completeness of any posted information.

ALL INFORMATION PROVIDED ON THE SITE IS PROVIDED “AS IS” WITH NO WARRANTIES OR GUARANTEES OF ANY KIND. GREENQLOUD EXPRESSLY DISCLAIMS TO THE FULLEST EXTENT PERMITTED BY LAW ALL EXPRESS, IMPLIED, STATUTORY OR OTHER WARRANTIES, GUARANTEES AND REPRESENTATIONS, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE OR PURPOSE, TITLE AND NONINFRINGEMENT OF PROPRIETARY AND INTELLECTUAL PROPERTY RIGHTS, AND WARRANTIES ARISING FROM A COURSE OF DEALING, USAGE OR TRADE PRACTICE. 9. Limitation of Liability

When you visit the Site or send e-mails to Greenqloud, you are communicating with Greenqloud electronically. We may respond to you by e-mail or by posting notices on the Site. You agree that all such notices, disclosures and other communications that Greenqloud provides to you electronically satisfy any legal requirement that such communications be in writing.

11. Governing Law and Jurisdiction

These Terms, together with any additional terms to which you agree when using particular elements of the Site, constitute the entire and exclusive and final statement of the agreement between you and Greenqloud with respect to the subject matter hereof. These Terms shall be governed, interpreted, construed and enforced in accordance with the UNIDROIT Principles (2010) without regard to any conflict of laws principles and by using this site you submit to the exclusive jurisdiction of the English courts. The failure of Greenqloud to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, you nevertheless agree that the court should endeavor to give effect to the intentions of Greenqloud and you as reflected in the provision, and that the other provisions of these Terms remain in full force and effect. These Terms shall remain in full force and effect notwithstanding any termination of your use of the Site.

Greenqloud respects your privacy and is committed to industry best practices and maintaining the privacy and confidentiality of personal data we collect.

This privacy policy describes Greenqloud’s practices regarding how information we collect on the Greenqloud websites is used and shared with third parties. By visiting the Greenqloud websites, you accept the practices described in this privacy policy. This privacy policy applies to anonymous data and personal information collected at our websites, and to personal information collected in connection with the sale, support and use of our products and services.

Greenqloud may collect personal information from you when you visit our sites, view and/or click on an advertisement, sign up for Greenqloud services, call Greenqloud by telephone or VoiP, email Greenqloud and its staff, chat or otherwise communicate with Greenqloud by any means.

“Visitor information” that may be collected includes data from anyone who communicates with Greenqloud by any means, whether that individual is a customer of Greenqloud or not. Visitor information also includes uploads to, downloads from or visits to our websites.

Visitor information collected can include your name, contact information, financial account numbers, IP addresses, date, time and duration of time spent on our site, search, keywords, referring URL, browser and operating system as well as services you select and orders processed on your behalf from Greenqloud.

This information is used to improve the user experience of our site, determine the needs of the market and our customers as well as to protect all visitors to our sites.

Information from other sources
In addition to manual data collection, through email, phone, chat and other communication means, we use various technologies to collect visitor information about all website visitors and those communicating otherwise with Greenqloud, including the use of cookies, web beacons (embedded in a web advertisement and on our site), analytics services and third party providers. Greenqloud affiliates located in the European Union may also provide us with personal information about their prospective or current customers.

We will not share or release information (except to third party service providers to Greenqloud, only when necessary to the performance function of those third party service providers, and only for the express purpose of those functions. No third party provider will be authorized to share information outside of these functions), unless you have given Greenqloud consent to such disclosure.

5. Obligated Disclosure of Data

We may be required to disclose your personal data to relevant authorities in some cases such as to comply with any legal obligation, breach of Greenqloud terms and conditions including but not limited to service and website terms and agreements, fraud protection and credit risk reduction. We may also disclose to third parties and relevant authorities personal data in cases where it is appropriate to comply with the law, enforce our legal rights, protect the rights and safety of others, or assist with industry efforts to control fraud, spam and other undesirable or illegal activity.

Any information collected about you while visiting our site or communicating with Greenqloud by any means will be used for the original purpose intended for that information only.

6. Opt Out

You have the right to opt-out of sharing information with Greenqloud. However, opting-out may limit access to our site and services.

You may opt-out of marketing services and correspondence by emailing our compliance and marketing teams at privacy@greenqloud.com.

Please note that it may take up to ten business days to remove your contact information from our marketing communications lists, so you may receive correspondence from us for a short time after you make your request.
